[FL] http://boalt.org/biplog/archives/635 Disturbing Number of Flaws Found in DMCA Takedown Notices Jennifer Urban, Assistant Clinical Professor of Law and Director of the Intellectual Property Clinic at the University of Southern California Law School and Laura Quilter, Fellow of the Samuelson Law, Technology, and Public Policy Clinic at the University of California at Berkeley School of Law (Boalt Hall) released a summary report (pdf) yesterday summarizing their findings after studying nearly 900 DMCA takedown notices collected by the Chilling Effects project. DMCA takedown notices are notices sent to Online Service Providers (OSPs) such as ISPs, web hosting providers, and search engines pursuant to 17 U.S.C. 512 that claim the service provider is providing access to material that infringes the claimant’s copyright and demanding its removal from the internet. If service providers comply with these notices they are granted a “safe harbor” from liability for the alleged infringement committed by their users/customers. Since service providers want to limit their liability without spending thousands of dollars on legal advice, most such notices result in the removal of the material from the internet without any evaluation of the merits of the takedown notice and often without notice to the alleged infringer. While this process is disturbing in its implications for free speech on the internet already, Urban and Quilter’s research presents further reasons for concern. They found that * Thirty percent of notices demanded takedown for claims that presented an obvious question for a court (a clear fair use argument, complaints about uncopyrightable material, and the like); * Notices to traditional ISP’s included a substantial number of demands to remove files from peer-to-peer networks (which are not actually covered under the takedown statute, and which an OSP can only honor by terminating the target’s Internet access entirely); and * One out of 11 included significant statutory flaws that render the notice unusable (for example, failing to adequately identify infringing material). Additionally, Urban and Quilter report that * Over half—57%—of notices sent to Google to demand removal of links in the index were sent by businesses targeting apparent competitors; * Over a third—37%—of the notices sent to Google targeted sites apparently outside the United States… [which raises] complex questions related to U.S. jurisdiction over foreign actors who run afoul of United States copyright laws—questions that OSPs are almost certainly not in a position to answer when deciding whether to pull material out of an index. While Urban and Quilter hesitate to draw firm conclusions from this data set, they write, The surprising number of questionable takedowns we observed, taken in conjunction with the ex ante removal of content, the minimal remedies for abuse of the process, and the lack of knowledge about the counternotice procedures, suggest that few are well-served by the current Section 512 process, and some or many individuals, as well as public discourse and the Internet’s value as an expressive platform, may be harmed. Auf der Verliererseite standen damals jedoch zwei der drei EV50-Sponsoren, nämlich der US-Softwarehersteller Microsoft sowie die für Microsoft, SAP und weitere Befürworter von Softwarepatenten tätige Lobbyingagentur Burson-Marsteller. Nach Müllers Einschätzung habe nicht nur er selbst, sondern vermutlich auch der Rockmusiker Bono mehr Stimmen als Juncker erhalten. Bonos Band U2 war im abgelaufenen Jahr laut Fachzeitschrift Billboard der erfolgreichste Live-Act im weltweiten Musikgeschäft. Während es für Müller und Bono zahlreiche Wahlaufrufe im Internet gab, sei eine vergleichbare Aktivität für Juncker auch in Luxemburg nicht feststellbar gewesen. Die Zahl der neutralen Wahlteilnehmer sei angesichts der kleinen Auflage der veranstaltenden Zeitschrift European Voice (ca. 16.000 Exemplare) keinesfalls groß genug, um zu Internet-Mobilisierungen solchen Ausmaßes ein zahlenmäßiges Gegengewicht zu bilden, das Junckers Wahlsieg plausibel machen würde. Zunächst wandte sich Müller an Juncker mit einem nichtöffentlichen Schreiben. Mil Jung, Direktor des Presseamtes der Regierung des Großherzogtums, beantwortetete dieses Schreiben mit dem Hinweis auf eine pauschale Zusicherung der Veranstalter, "dass es bei der Abstimmung über den Titel keinesfalls unrechtmäßig" zugegangen sei. Ein solches Zertifikat habe es auch nach der ukrainischen Präsidentschaftswahl im Jahr 2004 gegeben, ohne dass dies den Westen zufrieden gestellt hätte. Nach wie vor hat die European Voice nicht einmal die Gesamtwahlbeteiligung öffentlich gemacht, was Müller in seimem heutigen offenen Brief an Juncker als "Höchstmaß an Intransparenz" bezeichnet, "wie man es nicht einmal in der schlimmsten Bananenrepublik antrifft". Die Schätzungen Müllers besagen, dass sein politisches Lager (die Gegner der Vergabe von Patenten auf Computerprogramme) "30.000 bis über 50.000" Internetwähler zur Teilnahme bewegt habe, "während alle übrigen Teilnehmer maximal etwa 20.000 waren". Aufgrund dieser Zusammensetzung der Wählerschaft bestreitet Müller den proklamierten Wahlsieg Junckers, obwohl er nicht bezweifelt, dass der Premierminister bei einer repräsentativen Umfrage unter der EU-Bevölkerung besser als er abschneiden würde. Müller wirft Juncker nicht vor, den Preis "in gutem Glauben [...] von einem eigentlich recht angesehenen Verlagshaus", nämlich der britischen Economist Group, angenommen zu haben, ruft ihn aber nun dazu auf, "als demokratisch gewählter Politiker dafür einzutreten, dass auch bei einer Wahl wie EV50 gewisse Standards einzuhalten sind". Zwar räumt Müller ein, dass es sich hierbei "um keine politische Wahl im engsten Sinne" handelte, verweist aber auf deren "erhebliche europapolitische Relevanz". Juncker möge deshalb offiziell Müllers "von den Veranstaltern abgelehnte Forderung nach Offenlegung des Zustandekommens des Ergebnisses" unterstützen, ansonsten aber "den Titel nicht auf einer illegitimen Basis" behalten, sondern "entweder im Rahmen einer Wahlwiederholung unter notarieller Aufsicht erneut zur Abstimmung [...] stellen oder sich im Zweifelsfall von ihm [...] distanzieren". On trouve pages 28 et 29 de Libé de ce samedi 24/12 (pas trouvé les versions en ligne) une charge pour le moins brutale contre la licence globale, manifestement orchestrée par les majors, et où des artistes que l'on a connus plus clairvoyants se sont laissé entraîner. Parmis eux, on remarquera Benabar (dont je viens d'ailleurs d'acheter le dernier album, que je vous recommande), qui avait signé l'appel à l'arrêt des poursuites lancé par le Nouvel Observateur. Les grands arguments avancés sont les suivants : 1) Télécharger, c'est voler ! 2) La gratuité démagogue ! 3) Quelle répartition des recettes ? 4) Vous allez tuer la création ! 5) De l'argent pour les FAI mais pas pour les artistes ! Bref, le discours martelé par le SNEP depuis maintenant déjà quelques années... Quelques éléments de réponse : 1) Il ne faut jamais oublier qu'il s'agit ici de bien immatériels. Non, faire une copie d'une oeuvre ne revient pas à voler son support. Une fois que le support m'a été pris, je ne l'ai plus. Une fois qu'on a fait une copie de celle à ma disposition, il me reste toujours ma copie. 2) La licence globale n'est en rien gratuite. Nombre de personnes s'étaient d'ailleurs un temps ému de ce coût supplémentaire et cela a été l'un des principaux arguments pour retenir une offre optionnelle plutôt qu'une licence globale obligatoire. 5 euros par mois, cela fait 60 euros par an, à répartir ensuite entre les ayant droits. 3) Sans même évoquer les progrès que permet la technique, il est pour le moins curieux que des « poids lourds » de la scène musicale et la SACEM s'émeuvent de la difficulté à répartir une caisse entre ayant droits. Les sociétés de gestion collective sont pourtant rompues à l'exercice et ont l'habitude de recourir à divers sondages pour répartir les droits. Cela vaut toujours sur l'Internet. Mais il est également possible de faire mieux en analysant les flux transitant par les tuyaux des fournisseurs d'accès. Cette solution présente l'avantage de ne requérir aucune modification des postes clients, de ne pas imposer l'intégration d'une quelconque mesure technique dans les logiciels utilisés. Elle peut être anonyme et adaptée à la puissance de traitement actuellement à notre disposition. S'il serait en effet impossible d'analyser les flux en temps réel, et donc de filtrer, sauvegarder une tranche de flux (disons d'une heure), l'anonymiser (en changeant les adresses IP présentes dans le flux) puis la faire analyser par un tiers est envisageable. Cette analyse pourra à l'avenir tirer partie de meta-données spécifiques (des droits indiqués dans les fichiers), de « marques d'eau » (watermarking, sorte de signature intégrée à l'oeuvre) permettant de reconnaître l'oeuvre ; elle peut dès aujourd'hui consister en la comparaison de signatures calculées à partir des fragments de fichiers musicaux trouvés dans le flux avec une base de données de morceaux. Une telle solution serait, au passage, bien plus précise que les actuels sondages, dont on peine à croire qu'ils prennent en compte les morceaux joués lors d'une fête privée se déroulant dans une petite salle.. Autre argument à l'appui de cette faisabilité : les majors font déjà des statistiques des échanges sur les réseaux P2P et trouvent le moyen d'identifier et de porter plainte contre des échangeurs. Ce même type de technologie peut être utilisé pour rémunérer plutôt que pour réprimer. 4) Grâce à la répartition au plus juste de la véritable manne financière apportée par la licence globale, plus de créateurs pourront donc être rémunérés au plus juste et à moindre frais (un esprit taquin pourrait ironiser sur les frais généraux de la SACEM, mais peut-être n'est-ce pas le moment dans ce contexte tendu). Cela encouragera la création en améliorant son financement et en la rendant plus accessible au plus grand nombre. 5) L'argument de Benabar, que j'apprécie particulèrement, sur les 30 euros payés par mois pour l'accès internet contre 7 euros pour la licence globale m'a tout d'abord interpellé. Il est pourtant étrange : se préoccupe-t-on du modèle de la chaîne hi-fi de l'auditeur ? Faut-il faire payer plus cher au propriétaire d'une chaîne Bang&Olufsen qu'à celui d'un petit appareil aux performances douteuses fabriqué dans des conditions indéterminées ? Est-ce que l'on vend le carburant plus cher aux propriétaires de BMW (ou à ceux de 4x4 dont par le Benabar) qu'à ceux d'une Logan ? À l'évidence, non. Ce qui importe, c'est que la création soit financée. Mais Benabar met le doigt sur un point important : la non-progressivité de l'abonnement. Dans un monde idéal, une contribution proportionnelle devrait être prélevée et répartie selon à l'aide des systèmes mentionnés plus haut. Ce serait à l'évidence une meilleure solution. Une des clés de la sortie de ce débat invraisemblable, où l'on voit bien que gens de l'Internet et gens du spectacle ne se sont pas suffisamment parlé - la faute en revient au ministère de la culture - est peut- être dans la redéfinition de la répartition des revenus de la licence globale. Pas seulement entre les ayant droits actuellement sous le robinet de la copie privée (auteurs, artistes-interprètes et producteurs, pour rester dans le monde de la musique), mais en intégrant d'autres acteurs indéniablement créatifs, comme, par exemple, les ingénieurs du son Un bon mixeur apporte indéniablement un plus à un enregistrement, ainsi que sa personnalité. Pourquoi n'a-t-il pas droit à une rémunération (à un nouveau droit patrimonial) et à la reconnaissance de la personnalité de son travail (à un nouveau droit moral) ? Nous ne sommes plus en 1957, les chanteurs, les groupes sont rarement enregistrés en une fois devant un unique micro...
