Demande d'informations concernant un recours auprès de la cour de justice européenne

Bonjour Me Sotiri, J'étais l'organisateur pour LiLux <http://LiLux.lu> et Mensa Luxembourg <http://Mensa.lu> d'une conférence sur "La Protection des Données <http://bfrere.net/Conf%C3%A9rence%20protection%20donn%C3%A9es%20priv%C3%A9e…>" à laquelle vous avez participé en novembre, et je vous en remercie. Je vous contacte aujourd'hui car je désire connaître les modalités d'une action juridique à l'encontre de l'Etat français devant la cour européenne de justice, pour complicité d'abus de position dominante et distortion de concurrence. Le dossier complet est disponible en ligne à l'adresse suivante: http://BFrere.net/VCF Les faits sont les suivants: Depuis des années, de plus en plus de distributeurs d'ordinateurs de type "PC IBM compatible" conditionnent la vente de ces biens à la souscription conjointe d'un contrat de type "licence logicielle" en violation du droit européen, qui interdit la vente conjointe forcée. Des millions d'ordinateurs sont vendus chaque année en Europe dans la plus parfaite illégalité, mettant à mal le droit des utilisateurs à choisir librement leur fournisseur de logiciels, ce qui a mené progressivement à une situation de quasi-monopole sur ce marché, au détriment de la qualité et du choix pourtant garanti par la loi aux consommateurs. Plusieurs plaintes ont été déposées, dans divers États de l'Union, contre ces pratiques, exigeant l'annulation des licences illégalement vendues et leur remboursement. Ces procédures, individuelles et isolées, ont généralement été couronnées de succès, sans pour autant mettre fin aux pratiques illégales toujours constatées. Personnellement, je me refuse à acquérir un ordinateur dans ces conditions illégales, sachant que je devrais ensuite suivre une procédure longue et coûteuse pour un résultat insignifiant (la condamnation du vendeur au remboursement de quelques centaines d'Euros). Du coup, depuis fin 2001, je suis dans l'impossibilité de me fournir l'instrument de travail qui m'est indispensable. J'ai suivi progressivement toutes les démarches pour obtenir le respect du droit auprès des autorités compétentes (DDCCRF, puis DRCCRF, puis DGCCRF, puis médiateur de la république) pour finir par recevoir un document (page 1 <http://bfrere.net/VCF/images/DGCCRF%201-2.jpeg> et page 2 <http://bfrere.net/VCF/images/DGCCRF%202-2.jpeg>) signé du sous-directeur de la direction générale du contrôle de la concurrence et de la répression des fraudes, qui reconnaît tout simplement sa complicité avec les délinquants. Il estime en effet que la concurrence n'a pas lieu d'exister dans ce domaine, puisque le produit vendu de force est le meilleur choix pour le consommateur. Je conteste avec la dernière énergie le droit à un Etat de décider à ma place les fournisseurs qui fabriquent les produits qui doivent me convenir. Mon seul droit, en tant que consommateur, est le droit de choisir, et je ne peux donc me résoudre à y renoncer. Depuis lors, l'UFC-Que Choisir a entamé également une action dans le même sens, mais je n'en connaît pas l'avancement. Enfin, récemment, l'Etat français a décidé d'utiliser massivement dans la fonction publique les logiciels que je désirais utiliser depuis 2001: Linux, OpenOffice, etc... Dans ces conditions, vu le refus des autorités françaises de faire respecter la loi applicable et le droit européen, vu les dégâts causés au marché de l'informatique au delà des frontières françaises, vu les condamnations récentes (500 000 000+ EUR) imposées aux opérateurs téléphoniques pour entente visant à réduire la concurrence, vu les amendes imposées à certaines sociétés pour abus de position dominante par l'Union Européenne, et étant donné les preuves qui sont en ma possession, j'aimerais savoir sous quelles conditions un consortium d'associations (dont LiLux.lu <http://LiLux.lu>) et de particuliers lésés par ce scandales pourraient traîner devant les tribunaux européens à Luxembourg l'Etat français afin d'obtenir * l'annulation de toutes les licences vendues illégalement à partir du territoire français depuis le premier dépôt de plainte * la condamnation de l'Etat français à prendre toutes les mesures nécessaires au rétablissement d'un équilibre entre fournisseurs de logiciels dans le marché de l'ordinateur de type "PC IBM compatible" * la condamnation de l'Etat français pour sa faute lourde, ayant couvert et soutenu pendant tant d'années une pratique illégale qui avait été menée à sa connaissance * la condamnation de l'Etat français à la réparation de toutes les conséquences de la distortion de concurrence, comme les conséquences indirectes sur le prix de vente des produits et services qui intègrent le recours à des technologies informatiques * l'interdiction de vente des produits pratiquant la technique de vente conjointe forcée, y compris des logiciels ne fonctionnant que sur un système d'exploitation fourni par un seul et unique constructeur, des sites web ne fonctionnant correctement et complètement qu'à partir de logiciels fournis par un seul constructeur, du matériel dont l'utilisation requiers de tels logiciels, etc... * la condamnation de l'Etat français au remboursement des frais de développements de logiciels et d'adaptations des sites web induits par le point précédant sans que cette liste ne soit exhaustive. Hi I'm trying to compile a c++ program on kubuntu 7.10, but it doesn't. A while ago, all went fine. I suppose, there was an update for some package needed for compiling. J'ai essayé d'installer le package qu'ils fournissent pour Debian, mais l'engin n'est pas trouvé. Problème de reconnaissance de ce device sur Usb ? Merci pour votre aide, Jim

can't connect wireless (bluetooth) mouse on a Acer Ferrari4000 laptop

Hello, I'm working on a laptop Acer serie Ferrari4000 and after reinstalling the system (suse 10.2) I'm encoutering problems to connect bluetooth mouse; according to running bluetooth services with hci, spd, opd, rfcomm, hid and hid2hid activated, the kbluetooth applet icon stay in grey when I'm pushing pluging button to activate adaptator; if I'm doing hidd --search i get answer: No device in range or visible If I'm doing hidd --connect <adress> i get an time-out answer and reply: Host is down If I'm doing hcitool cc <adresse> I get also a time-out answer and reply: Can't create connection: input/output answer I'm actually infered to think that someting have not been correctly installed on the system, maybe concerning rights on a particuler file or directory...but I don't know...Any suggestion? Troubleshooting an SD-Card

Hello, I have been asked by a friend for help with an SD-Card which apparently is corrupted, to rescue the 120 pictures stored on it , if possible. Apparently, the camera repeatedly asks the user if it should or not reformat the card. So I first tried to mount that card into my system, using an USB card reader. Now, I would be very grateful if somebody could give me any hints how I could possibly recover the image data contained in the dump or if there is any way to use these data in a way that would enable me to get back the data. Various binaries on the same system ???

I have two servers based on the very same hardware. They both run the very same distro (RH4), the very same kernel (uname -r), and have the very same list of installed packages (rpm -qa) However, numerous binaries, including /bin/ps, /bin/bash, /bin/ls, and librairies do not match. They have * the very same length * the very same date but they have different hashes, because they have different contents (cmp fails) The differences are inside, not at the end. We searched for a rootkit, but didn't found any. The two different ps commands, copied from one to the other, show the same result. I tried rpm --verify. No probem. However, when replacing one binary by the one coming from the other host, rpm --verify compains... Is it normal to have differences in binaries on the same hardware, same distro, same kernel and same packages ??? Is there a "signature" added in some binaries ? Might the order of the installation cause such effect ? The problem is that I have, at the same customer site, two other servers that are exactly in the same situation, but running CentOS, and I have the same strange beheaviour... file recovering under ext3

Hi, I have unfortunately deleted a text (source) formatted file on my HD by doing command rm; is there any mean to recover it under ext3 Ifound many utilities but only working under w$ Otherwise it's said it's possible to do that using ext3 journalization but I don't know how to proceed Thank you for suggestions cheers M.
